Generic passport, Australian outline and branching path around the title Condition 8503: pending visas and onshore grant.

You have a visa application waiting for a decision. That visa normally allows grant while you are in Australia, so you plan to visit while it is processed. But your visitor visa includes condition 8503, “No Further Stay”.

Do not assume the earlier application protects you from that condition. It can prevent an onshore grant even where the pending visa would ordinarily allow one. Before travelling, check the conditions and the specific rules for the visa you are waiting for.

What does 8503 restrict?

Condition 8503 restricts the grant of another substantive visa while the holder remains in Australia after entering. Its stated exception is a protection visa. “Substantive” excludes bridging visas, so the rule should not be described as a ban on every possible visa. There is no general Partner subclass 820 exception. Condition 8503 and Migration Act definitions.

Does lodging before travel avoid the problem?

Not necessarily. Two questions need separate answers:

  • Was the application valid when it was lodged?

  • Can the visa lawfully be granted in your circumstances when a decision is made?

A valid earlier application does not itself remove a later restriction affecting grant. Conversely, a grant restriction is not automatically proof that the earlier application was invalid or must be withdrawn. New applications made in Australia can face separate validity restrictions. Migration Act, sections 46 and 65.

Can I leave Australia to have the pending visa granted?

Possibly, but departure is not a universal solution. Check whether your particular visa can be granted offshore, whether any exception applies, and whether all its other criteria remain satisfied. A visa that requires your presence in Australia at grant cannot simply be treated as an offshore-grant visa. Migration Regulations, regulation 2.04 and visa-specific Schedule 2 criteria.

Leaving does not itself remove 8503 from the existing visitor visa. Returning on that visa before the pending application is decided may bring the onshore grant restriction back into play. Condition 8503.

Do not book a short trip assuming a grant will arrive within it. Departure is not approval or a processing deadline. Check any Department instructions and allow for delays before committing to flights, accommodation or a return date.

When might a waiver be available?

One general waiver pathway concerns compelling and compassionate circumstances that developed after visa grant, were beyond your control and caused a major change in your circumstances. A written request needs evidence showing how that test is met. If a previous request was refused, substantially different circumstances are required.

That is not the only statutory pathway. There are additional grounds for specified situations and visa classes, including certain skilled visas. Those provisions are not an automatic exemption for every pending application. The appropriate ground must be assessed individually. Migration Regulations, regulation 2.05.

Home Affairs provides an online waiver request form. Its Form 1447 guidance explains supporting documents and alternatives if the online form cannot be used.

Does a waiver guarantee the pending visa?

No. A successful waiver removes the relevant condition, not the remaining application or grant requirements. Requesting a waiver does not extend your current visa or itself give you permission to remain after your lawful stay ends. Do not assume the request creates a bridging visa. Home Affairs waiver guidance.

What should I check before travelling?

  • Your grant notice and VEVO, including the actual conditions and permitted stay.

  • The pending visa’s application and grant-location rules, including any relevant exceptions.

  • Whether 8503 affects the proposed sequence and whether a waiver ground is available.

  • Outstanding Department requests and a practical plan if a decision takes longer.

Home Affairs has announced wider use of No Further Stay conditions as part of a migration-policy package being progressively implemented over 12 months. This is not a basis for saying every visitor visa granted from 2 October 2026 automatically has 8503. Check the individual grant. Home Affairs migration-policy changes.
